Abstract

The violation of human rights during the Chilean dictatorship between 1973 and 1990 has led the State to enact laws of reparation to the victims for the damage suffered. The article develops -under the theory of the law of damages- the principle of compensatio lucri cum damno, to establish the appropriateness of imputing and complementing the cash benefits granted by the State to the victims of political repression, with the compensations granted by the Judiciary. For this purpose, the jurisprudence of the Supreme Court and the history of reparation laws will be analyzed. Finally, it is concluded that emanating from the same wrongful act, having a reparatory nature of damages, compensation is possible.
