Abstract

The author presents and examines a judgment of the Supreme Court which deals with the validity and legal nature of instructions given to a notary in the context of real estate transactions, directing them to deliver one set of bank vouchers to a third party not involved in the transaction, and a second set to the seller, once it is proven, through the respective certificates, that the real estate subjects of the transaction were registered under the buyer's name, free from any liens, restrictions, or attachment; reviewing the opinion of the commented judgment and the national doctrine on the matter.
