Intermediación de la declaración en juicio oral de niños, niñas y adolescentes: Construcción de un protocolo y formación especializada

Abstract

The Law No. 21.057, effective in Chile since January 2018, introduces several changes to the criminal justice system aimed at providing proper treatment to children and adolescents who have been victims or witnesses of sexual and violent crimes. In this context, some modifications are made to the testimonies of child and youth victims in criminal trials, creating a protocol for intermediation for these instances. This article will address the protocol in relation to its national and international background, its construction process, the stages that constitute it, and the training necessary for its correct implementation, along with the systemic challenges and those specific to the judiciary concerning this topic.
