Abstract

This paper is about the complex relationship between judges and politics, and makes a description and critical analysis of the experiences of Peru, Spain and Argentina in relation to their Judicial Councils. Based on this, a form of membership of said Council is proposed that is compatible with the principles of independence and impartiality of judges, within the framework of the constituent process.
