Abstract

The author analyzes the decision of the Supreme Court in execution of the judgment issued by Inter-American Court of Human Rights in Norín Catrimán et al. v. Chile case, regarding its pronouncement to annul without invalidating the conviction. With this, the author maintains, it is avoided based on a grammatical twist and an unauthorized originalist interpretation of the Constitution, a pressing problem of constitutional facticity.
