Abstract

The purpose of this paper is to present the international human rights jurisprudence, both of the European Court of Human Rights and of the Inter-american Court of Human Rights on the right to a fair court for its analysis in the field of criminal jurisdiction as well as examine whether or not the national legal system and the jurisprudence meet the standards that seem consolidated in this area. Moreover, a critical review of the military jurisdiction will be made, both from the point of view of the rights of the accused and the victim.
