¿The judge’s right to irremovability?

Abstract

This article presents that inter-american jurisprudence has established that judicial independence should not only be analyzed as the right to an independent judge but also as the judge’s right to irremovability. With this objective, the relevant jurisprudence of the Inter-American Court of Human Rights is analyzed in order to clarify the general criteria affirmed on judicial independence and the right to an independent judge. It also examines whether the judge’s right to irremovability is a central element of judicial independence.
