Abstract

This text presents the fourth issue of the Journal of Judicial Studies, published by the Hernán Correa de la Cerda Institute of Judicial Studies as part of its mission to foster debate on the justice system. This edition is structured around a specific theme: precautionary measures in the Chilean legal system, approached from a perspective focused on their conceptual and practical renewal, particularly in the context of the procedural reforms of recent decades.

The issue is organized into three sections. The first includes an interview with Enrique Barros Bourie and various doctrinal studies analyzing precautionary measures in civil, criminal, family, and labor contexts, incorporating theoretical and practical approaches to their application, limits, and foundations. The second section contains jurisprudential analyses focused on Supreme Court decisions, addressing matters related to fundamental rights, procedural remedies, and requirements for reasoning. The third section is dedicated to bibliographic reviews of recent relevant works in the procedural field.

Taken together, the publication seeks to offer a specialized and up-to-date approach to the power to grant injunctions, promoting critical reflection on its role in the effective protection of rights.
