Abstract

This article aims to make a critical review of infraction proceedings in Family Courts, identifying the critical problems presented by the enacted regulations, especially with regard to jurisdiction rules and human rights standards about children and adolescents. This analysis spans the issued rule of the Court of Appeals of Santiago on November 25th 2015, that attributes jurisdiction to hear the subject matter to the Family Court of Puente Alto, and the constitutional judgment in this matters issued on March 3rd 2016 by the Constitutional Court.
