The Supreme Court role in the chilean rule of law

Abstract

This paper explains the functions of the Chilean Supreme Court, both administrative or government of the judiciary, as the cassation function. The two firsts are lightened for having a relative political nature, which differentiates our Court of its European and American counterparts. Regarding his role as a cassation Court, this paper examines what this role means today, pointing out that the cassation endowment should focus on an authoritative interpretation of the law, which from a specific case sets universalizable rules to the future, and fulfilling in this way a quasi-legislative function, more than a strictly jurisdictional one.
