Abstract

This review examines the Manual de Derecho Disciplinario Judicial by Luis Vacas García-Alós and Gervasio Martín Martín, a work aimed at systematizing the disciplinary regime applicable to judges and magistrates in Spain as a manifestation of administrative sanction law. The text presents this discipline as a mechanism of dual guarantee: on the one hand, providing effective oversight against potential violations in the exercise of judicial functions, and on the other, safeguarding the constitutional principles and fundamental rights that govern due process.

The work is structured into five chapters that address the foundations of Judicial Disciplinary Law, its relationship with state ius puniendi, the classification of disciplinary offenses, the applicable procedure, and the system of sanctions. The analysis is based on a review of the relevant legislation -particularly the Organic Law on the Judiciary and disciplinary regulations for the civil service- and on a systematic study of the case law of the Constitutional Court and the Spanish Supreme Court.

Overall, the manual offers a comprehensive approach to this area of law, highlighting the systematization of jurisprudential criteria and its usefulness as a reference for the study and potential reform of the judicial branch’s disciplinary control systems.
