Exercise of disciplinary control by the Council of the Judiciary for the violation of Abuse of Rights, in light of the precedents of the Constitutional Court of Ecuador

Abstract

This article falls under the category of jurisprudence commentary, as its focus is the study of precedents from the Constitutional Court of Ecuador regarding the exercise of the Judicial Council's disciplinary power in cases of abuse of power. The objective is to highlight the legal problems associated with the lack of clear procedures and an imbalance in fundamental guarantees such as the right to defense and the principle of legality. To this end, a descriptive legal research model and the use of tools such as case studies have been employed.
