CONSIDERATIONS ABOUT THE TRUTH AND TRANSITIONAL JUSTICE

Abstract

In the context of transitional justice, the perspective of the legal and social role of truth in liberal democracy is addressed, as a necessary condition for the effectiveness of the law, specifically so that the administration of justice manages to overcome the vagueness of meanings on the truth in determining the factual circumstances of each controversy. Assuming that justice presupposes the verification of the truth of the facts, the author links the aforementioned property to the quality of the construction of democracy.
