NOTARIAL INSTRUCTIONS, VALIDITY, AND LEGAL NATURE. APPLICABLE LEGAL STATUTE AND NOTARY’S RESPONSIBILITY

Abstract
The author presents and examines a judgment of the Supreme Court which deals with the validity and legal nature of instructions given to a notary in the context of real estate transactions, directing them to deliver one set of bank vouchers to a third party not involved in the transaction, and a second set to the seller, once it is proven, through the respective certificates, that the real estate sub- jects of the transaction were registered under the buyer’s name, free from any liens, restrictions, or attachment; reviewing the opinion of the commented judgment and the national doctrine on the matter.
